Distance agreement for the online shop RecoveryBoots.shop

IK AC Fizio, registration No: 40002209858 (hereinafter – the Seller), legal address: 9-60 Mirdzas Kempes Street, Riga, LV-1014, on the one hand,

and the person ordering the goods (hereinafter referred to as the “Buyer”), of the other part, enter into the following Agreement.

1. Subject of the Agreement

1.1. The Seller undertakes to sell and deliver to the Buyer the goods in accordance with the order placed by the Buyer in the Seller’s online store RecoveryBoots.shop (hereinafter – the Online Store).

2. Delivery and payment

2.1. The Buyer orders the goods via the Internet shop’s website – RecoveryBoots.shop, specifying the type of goods to be ordered, quantity, delivery method and other characteristics of the goods – colour, weight, size, model.

2.2. The Buyer may pay for the goods in the following ways: by using the payment tools embedded in the Online Shop or by paying the invoice prepared by the Seller and sent to the Buyer by e-mail corresponding to the order. The invoice is drawn up electronically and is valid without a signature.

2.3. The Seller shall ensure delivery of the goods within 30 days from the date on which the Buyer has paid in full for the goods and the delivery costs if the Buyer has opted for delivery against payment. The date of payment shall be the date on which the payment amount is credited to the Seller’s account. The Seller shall agree the time of delivery with the Buyer.

3. Right of withdrawal

3.1. The Buyer has the right to exercise the right of withdrawal in accordance with the Consumer Rights Protection Law and the Cabinet of Ministers 20.05.2014. the procedure set out in Regulation No 255 “Regulations on distance contracts”.

3.2. In the case of a right of withdrawal, the goods must be intact. The goods may be tested only to the extent necessary to familiarise oneself with their technical characteristics, their nature and their functioning. You may use the product as much as you would have done before buying it in a normal shop.

3.3. The buyer is responsible for preserving the quality and safety of the goods during the period of exercise of the right of withdrawal if the goods have been used for purposes other than to establish the nature, characteristics and functioning of the goods.

3.4. If the buyer wants to exercise the right of withdrawal, the buyer must pay the return costs.

3.5. If the buyer has opted for a delivery method other than free or the cheapest standard delivery method offered by the seller, the seller shall not reimburse the buyer for the additional delivery costs.

3.6. To exercise the right of withdrawal, the buyer must inform the seller of his decision to withdraw from the contract before the expiry of the right of withdrawal by submitting a withdrawal form to the seller or by sending an electronically completed form by email to the seller before the expiry of the right of withdrawal: info@recoveryboots.shop or physically deliver the completed form to the registered office of IK AC Fizio, 9-60 Mirdzas Kempes Street, Riga, LV-1014.

3.7. If the buyer sends the goods together with the withdrawal form or the notice of exercise of the right of withdrawal, the goods and the withdrawal must be sent to the following address: IK AC Fizio, DPD Parcel machine Maxima Rusova, Rusova iela 1, Riga, LV-1026.

3.8. The buyer must return the goods without undue delay and no later than 14 days from the date on which the buyer submitted the withdrawal form or notified his decision to exercise the right of withdrawal. The deadline will be met if the buyer returns the goods before the end of the 14-day period.

3.9. The seller is entitled to withhold reimbursement of the amount paid by the consumer under the purchase contract until the seller has received the goods or the consumer has provided the seller with proof that the goods have been returned, whichever is the earlier.

3.10. The Seller must return the funds paid by the Buyer within 10 working days.

4. Dispute resolution

4.1. The buyer has the right to bring a claim for non-conformity within 24 months from the date of delivery of the goods, as set out in the Consumer Rights Protection Act.

4.2. The Buyer may submit a claim for the goods to the Seller by submitting a written application by post to the following address: IK AC Fizio, Mirdzas Kempes iela 9-60, Riga, LV-1014, or by e-mail: info@recoveryboots.shop.

4.3. The application shall be accompanied by copies of the documents evidencing the transaction and, where possible, other documents.

4.4. The application must contain – the name, surname, home address, contact details, date of application, nature of the dispute, claim and grounds for the claim.

4.5. The application will be examined within 15 working days of receipt, with a reply sent to the contact address provided in the application.

4.6. If the claim is found to be unfounded and the buyer does not agree that the claim is unfounded, the buyer has the right to use the alternative dispute resolution options provided for in the laws and regulations.

5. Data processing

5.1. By entering the necessary information and placing an order, the Buyer confirms that he/she is familiar with and agrees that the data provided by him/her will be used to enable the Seller to accept the Buyer’s order and deliver the goods in accordance with the requirements of the laws and regulations of the Republic of Latvia. By entering the information, the buyer agrees to receive notifications related to the processing of the buyer’s order to the e-mail address provided.
